4/24/08 Not surprisingly, after today's legal ruling on the lawsuit regarding City/County of Santa Cruz v CDFA that has temporarily halted the LBAM spraying over Santa Cruz County, Governor Schwarzenegger announced a temporary postponement of the light brown apple moth spraying throughout the state.
"After meeting with lawmakers and environmentalists, Gov. Arnold Schwarzenegger said later Thursday that the state would suspend all aerial sprays across the state until August 17, by which time further "acute testing" of the spray's impact on humans would be complete. The governor expressed confidence that the tests would clear the way for spraying to resume in late August.
Governor Schwarzenegger's office did state that it would comply with the judge's ruling unless it is overruled by an appellate court decision.
5/8/08 Mark your calendar:
HOPE v CDFA will be heard in Monterey County Superior Court. This lawsuit is based on the same issues as the Santa Cruz legal case, which the judge just ruled on.

It’s early afternoon and today has already been a busy day. Postponement is the word of the day. I met with the Governor earlier today. Flanked by Senator Migden, Senator Steinberg, AG Kawamura, Marin County Ag Commisioner Stacy Carlsen and a couple of other folks. The Governor and his staff are thinking about the issue right, which is that these pesticide products need to go through a serious round of testing, both for health and environmental impacts. They are doing that to meet our concerns and clear up communication problems they have had to date. Our bottom line is that any and all products should be tested for their long-term and (acute) short-term impacts. We need to make sure this is incorporated into any future testing. The Administrations plan is to review these products as quickly as possible, with the goal of August 17th in mind.
Many of you already know that the Santa Cruz County court case determined that pesticide spraying should stop until an Environmental Impact Report is conducted. Just go to google news and you will see the numerous articles on the topic. The State has already vowed to appeal that decision because of the precedence it sets for future agricultural emergencies. I know that the County will keep fighting for an environmental review first, which may be moot in the end with an August 17th timeline.
Keep up the great work. With your continued efforts the Schwarzenegger Administration will continue to meet our needs.

The state cannot spray in Santa Cruz until an environmental impact report is done, and the spray has been delayed until Aug. 17 in all areas while the state conducts tests of the possible pesticide formula. One immediate area of concern to me is that the tests are all "acute" toxicity tests, which are based on 30-minute exposures. This is all that was previously done for the active ingredient in Checkmate, so it does not appear to me to be adequate testing to determine long-term human exposure safety, and it's not clear whether they are testing the whole formula or just the pheromone. I await the comments of our expert medical advisors on these issues.
But meanwhile let's celebrate the delays in the spray date!
